Entry purchaser, and anyone to whom an entry purchaser legally transfers an entry, must be either a business entity or an individual 21 years or older at time of entry purchase. Individuals buying on behalf of a business/legal entity must be legal representatives of the business and must, themselves, be 21 years or older at the time of entry purchase. Initial entry purchaser must be present in the state of Arizona at the time of entry purchase. It is not necessary to be a resident of the state of Arizona, but one must be physically present in Arizona at the time of entry purchase. Only one (1) individual may be identified as an entry purchaser. All federal, state and local laws and regulations apply. Tucson Medical Center Mega Raffle (the “Raffle”) is conducted in English (with Spanish speaking representatives available at the call center). Entries may be purchased via the internet or the call center. Entry purchasers providing the Raffle with a valid email address will receive confirmation number(s) by return email. This is the only confirmation that will be provided. For all other entry purchasers, ticket confirmation number(s) will be mailed within ten (10) business days of purchase. A copy ticket confirmation number is not required to claim a prize. Questions concerning ticket confirmation number(s) should be directed to the “Administrator,” Eide Bailly LLP, at the address listed below. For security purposes, the Administrator will attempt to confirm all purchases of $2,000.00 or more. Orders which cannot be confirmed will not be filled. By entering the Raffle, the entry purchaser acknowledges that he or she is aware of, and agrees to abide by, the Raffle’s rules and regulations. The following individuals and their respective affiliates, subsidiaries, parent and related companies and agencies are not eligible to win a prize in the Raffle: (a) Executive management and officers of Tucson Medical Center; (b) Executive management of TMC Foundation; (c) partners and employees of Eide Bailly LLP and its subsidiaries; and (d) Executive Director of the Raffle. The above list of exclusions (items a, b, c, and d) also applies to immediate family members residing in the same household.
MAIN RAFFLE DRAWINGS
Only 50,000 tickets will be sold at two price points with limited quantities of each: single tickets for $100 and 3-packs for $250. Draw dates are: Appreciation Draw – February 15, 2017, for which entries will be accepted until midnight February 8, 2017; Early Bird Draw – March 15, 2017, for which entries will be accepted until midnight March 9, 2017; Final Draw – April 5, 2017, for which entries will be accepted until midnight March 30, 2017. Final Draw deadlines will be adjusted in the event of early sellout as described in the following paragraph. Prizes with the lowest manufacturers’ suggested retail price will be drawn first progressing in order to the Grand Prize. Should all entries be sold out by midnight March 9, 2017, all draws for the remaining prizes will be made on the Early Bird Draw date. After each draw, the winner’s entry number will be returned for all subsequent draws. Each entry remains in the draw for all prize drawings. If entries are not sold out by midnight March 9, 2017, entry purchasers who purchased before midnight March 30, 2017, are eligible for all of the remaining 2,565 prizes on the Final Draw date of April 5, 2017. In the event entry sellout occurs after midnight March 9, 2017, but before midnight March 30, 2017, the Final Draw will be held six (6) calendar days after entry sellout or on the scheduled draw date, whichever comes first. If the sixth day falls on a weekend or legal holiday, the draw will be the next business day. Entry purchasers may win more than one prize. Requests for ticket cancellations and ticket reassignments must be made by noon, February 10, 2017, prior to the Appreciation Draw; noon, March 10, 2017, prior to the Early Bird Draw or noon, and three (3) business days prior to the Final Draw date. All entries are non-refundable after the noon deadline or once an entry has been included in any draw.
50/50 RAFFLE DRAWING
Participants in the Main Raffle have the option of also participating in the 50/50 Raffle at the time of their purchase of the Main Raffle ticket(s). There will be one drawing immediately following the Main Raffle Final Draw. 50/50 Raffle tickets will be sold at three price points: single tickets for $10, 5-packs for $25 and 15-packs for $50 and can only be purchased in combination with the purchase of Main Raffle tickets. There is no limit to the number of 50/50 Raffle tickets that may be sold. The winner of the 50/50 Raffle will receive one half of the proceeds received from the sale of 50/50 Raffle tickets (the rest of the proceeds will be retained by TMC). Requests for ticket cancellations and ticket reassignments must be made by noon of the third business day prior to the Final Draw date. Cancellation of the Main Raffle ticket that allowed the participant to purchase the 50/50 Raffle ticket will automatically result in the cancellation of all associated 50/50 Raffle tickets. All entries are non-refundable after the noon deadline.
In the Raffle, there is no possibility of a tie. All draws will be under the supervision of the Administrator. All time references are Mountain Standard Time.
The odds of a single ticket winning a prize vary depending on the number of tickets sold and the phase (Appreciation, Early Bird or Final) in which the ticket is purchased; however, the odds for the Main Raffle are never greater than 1 in 20. The odds for the 50/50 Raffle are solely dependent on the number of tickets purchased and, because there is no limit on the number of 50/50 Raffle tickets that can be purchased, the odds for the 50/50 Raffle drawing cannot be estimated or guaranteed. 2,578 prizes will be awarded. Prizes may not be exactly as shown in the brochure or on the web site and are based on manufacturers’ availability. If unavailable, similar or like kind prizes may be substituted at the sole discretion of the Administrator. The approximate retail value of all combined prizes is more than $2,137,000.00 MSRP (manufacturer’s suggested retail price), based on pricing at the time of prize selection. All MSRPs are rounded to the nearest dollar. No prize is valued at less than $100.00 MSRP. Only specified prizes may be exchanged for cash value. When airfare is included in a prize, unless otherwise stated, the fare is round-trip economy class from anywhere in the contiguous United States for two persons. With proper transfer or sales documents bearing notarized signatures, as required by the Raffle, a prize may be transferred or sold. Prizes may also be donated back to Tucson Medical Center.
NOTIFICATION OF WINNERS
All winners will be notified via courier, mail, or by email, where available, by the Administrator of the requisite procedure to claim the prize. All Grand Prize winners and the 50/50 winner must claim their prize within fourteen (14) calendar days of the draw. Grand Prize winners of homes will be responsible for closing costs including Homeowners’ Association Dues. Winners of vehicles are required to claim their prize within twenty-one (21) calendar days of the draw (with the exception of custom vehicles, details for which will be provided in winner notification). All vehicle winners shall be responsible for any and all state or local license, title, registration, documentation and prep fees associated with the vehicles. All remaining prizes are to be claimed by winners within six (6) months of the draw unless otherwise stipulated in the prize letter. Three (3) business days after the completion of the Final Draw, entry purchasers can access www.TMCmegaRaffle.org to check prize winning status using their ticket confirmation number or their name and phone number. Also, at that time, a complete prize winners list with winners’ names and locations by city or town, and state, will be available on the website. A printed version of the prize winners list will be available within 30 days of the Final Draw by contacting the Administrator (contact information below). Using the information provided, if a selected winner is unable to be contacted or located prior to the deadline for claiming the prize, the prize or a cash equivalent will revert to the Tucson Medical Center. In the event a winning entry has more than one name listed on the ticket, the Administrator, Eide Bailly LLP, will physically award the prize to the first name listed on the entry. For tax purposes, the prize can be split among all verified prize winners. Neither Eide Bailly LLP, Tucson Medical Center Mega Raffle Executive Director, Tucson Medical Center, TMC Foundation nor their legal counsel are responsible for resolving disputes which may arise from any conflict between or amongst joint ticket holders or purchasers.
By entering the Raffle, entry purchasers agree that their information provided in connection with the Raffle entry may be used for communications promoting the Raffle and future raffles sponsored by or conducted for the benefit of Tucson Medical Center. An entry purchaser may subsequently “opt-out” of the receipt of such communications by following the directions in any email, other communication or by contacting the Administrator (contact information below). Other than as provided herein, or as required by law or court order, an entry purchaser’s information will not be shared with or sold to any other person or entity. Purchase of an entry in the Raffle constitutes permission for the Raffle and Tucson Medical Center to use winner’s name, address and/or likeness, in perpetuity, for purposes of advertising the Raffle or future raffles without further consent or compensation, unless prohibited by law.
Potential winners must complete all steps outlined in their winners’ letter within the designated timeframe. If an entrant is found to be ineligible, or if a potential winner does not comply with the Official Rules, then the potential winner will be disqualified and the prize or a cash equivalent will revert to Tucson Medical Center.
In the unforeseen event the Raffle is canceled or cannot be completed, every effort will be made to refund the ticket purchase price to all Raffle ticket purchasers. Tickets purchased by credit card will be refunded to credit card holder’s account. Eide Bailly LLP, Tucson Medical Center and TMC Foundation’s combined liability to any ticket purchaser is the purchase price of the ticket.
WAIVER/LIMITATIONS OF LIABILITY
Except as described in the previous paragraph, entry purchasers, by participating (and winners, by accepting a prize), release Tucson Medical Center, TMC Foundation and their respective parent companies, affiliates, partners, subsidiaries, agents, representatives, sponsors, service agencies and independent contractors, and each of their respective directors, officers, partners, employees and agents, including advertising and promotion agencies, from any and all liability with respect to participation in the promotion, possession, use and distribution of the prize(s) awarded.
The Raffle will pursue all available legal remedies against any individual(s) damaging or attempting to damage any Tucson Medical Center Mega Raffle website or attempting to undermine the lawful operation of the Raffle.

In the event a dispute shall arise between the purchaser and Eide Bailly LLP, Tucson Medical Center Mega Raffle Executive Director, Tucson Medical Center and/or TMC Foundation, any controversy or claim arising out of or relating to the raffle, shall be settled by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The place of arbitration shall be in the State of Arizona. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
Neither Eide Bailly LLP, Tucson Medical Center Mega Raffle Executive Director, Tucson Medical Center, nor TMC Foundation shall be in default or otherwise liable for any delay in or failure of its performance of the raffle if such delay or failure arises by any reason beyond reasonable control, including any act of God, any acts of the common enemy, the elements, earthquakes, floods, fires, epidemics, riots, failures or delay in transportation or communications, or any act or failure to act by the other party or such other party’s employees, agents or contractors.
Should a dispute arise between a purchaser and Eide Bailly LLP, Tucson Medical Center Mega Raffle Executive Director, Tucson Medical Center, and/or TMC Foundation, purchaser agrees that all cases, controversies, and legal issues shall be governed by the laws and jurisdiction of the State of Arizona.
TAXES AND IRS RULES
All winners shall be responsible for any and all federal, state and local income or excise taxes, fees, assessments and like charges associated with the prizes. All cash prizes will be paid net of applicable income tax withholding.
At the time of this printing, federal law requires that corresponding tax withholding on prize values of $5,000 or greater must be collected from winners upon award and distribution. Federal and state withholding laws are subject to change without notice. The withholding laws in effect at the time prizes are claimed will be followed. The IRS has taken the position that amounts paid for chances to participate in raffles, lotteries or similar programs are not gifts and, therefore, the price of the entry does not qualify as a deductible charitable contribution.
